Change to the VG Konz land use plan for the “Im Pesch” area in Oberemmel - public participation in accordance with Section 3 Paragraph 2 of the Building Code

At its meeting on February 6, 2024, the Konz municipal council decided to publicly display the draft land use plan change “Im Pesch” in Oberemmel, including the draft justification and environmental concerns. The participation of those responsible for public affairs takes place parallel to the participation of the public.

The city of Konz is planning to expand the Oberemmel daycare center. Due to the requirements of the state law on the further development of the upbringing, education and care of children in day care centers and child day care (KiTa Future Act), there is an increased space requirement and additional demands for child care places in day care centers. An extension to the existing daycare building is planned. This construction project on the intensively used daycare site requires sound planning and a construction phase that is coordinated with the operation of the daycare center. In order to enable the required short-term expansion of the Oberemmel daycare center, the construction of a temporary expansion wing is planned. The temporary extension wing is to be built on the opposite side of the street “Im Großengarten” on the parcels in the Oberemmel district, corridor 11 16/1, 17/1 and 18/1. The current designation of the parcels in the land use plan as areas for agriculture and forests, intended purpose: grassland focus with basic requirements, stands in the way of the construction of the temporary expansion wing. In order to achieve the goal of the planning, the construction of the Oberemmel daycare extension, it is necessary to change the land use plan in the affected parcels to an area for public use.

According to Section 3 Paragraph 2 of the BauGB dated November 3, 2017 (BGBI. I p. 3634) in the version of the last amendment dated December 20, 2023 (BGBI. 2023 I No. 394), the draft of the land use plan amendment “Im Pesch” as well as the draft the justification and environmental concerns in the period from

February 20th to March 21st, 2024

at the Konz municipal administration, administration building II. The following documents are available: 1.) Plan document 2.) Justification and environmental concerns. The documents are available for inspection at VGV Konz in room 62 during general office hours. Citizens have the opportunity to submit suggestions in writing or on record. According to Section 4a Paragraph 6 of the BauGB, it is pointed out that statements that are not submitted in a timely manner may not be taken into account when making a decision on the change in the land use plan.

As part of the public display, the following environmental information can be viewed in the justification:

Protected soil/area:

As part of the implementation of the planning, temporary impairments to the soil are to be expected. Adverse effects on the protected soil/surface occur throughout the entire construction site area due to compaction and disturbance of the soil through removal and rearrangement during construction site operations. The loss of naturally grown soil due to temporary resealing during the construction of the building and the access routes or installations cannot be avoided.

Water as a protected asset:

There are no water protection areas within the scope. There are no bodies of water within the planning area. The Oberemmeler Bach, south of the planning and the Weierbach in a northwesterly direction, will not be affected. Soil compaction as a result of traffic and relocation of soils can be expected to reduce seepage (reduced groundwater recharge rate) and increase surface runoff. In the area of the building and the access routes or installations, the temporary resealing leads to a complete loss of the infiltration capacity of the soil and thus to the loss of rainwater retention on these areas.

Danger of flash floods: The flash flood danger map from the State Office for the Environment shows a high risk of flash floods for the Oberemmel area. In the event of an exceptional heavy rain event (SRI07 1 hour), water depths of up to 80 cm would be reached in the planned area.

Protected climate/air:

Due to its small size, the planning area is of no relevance to the protected climate. Construction-related pollution from exhaust gases and dust is very limited in terms of space and time.

Protected plants and wildlife:

In the landscape plan, the area is shown as other grassland. The planned area is currently used as pastureland. The trees in the southeastern edge area are not affected by the planning. It cannot be assumed that a generally protected biotope in accordance with Section 30 BNatSchG or Section 15 LNatSchG will be affected. The planned designation of building land is associated with a temporary loss of a low-value biotope.

Landscape/Recreation:

In the landscape plan of the VG Konz Map 5 “Protected landscape” the plan area is counted as open land and semi-open land (including forest-openland mosaic) with a small proportion of landscape-typical, structured structures. The importance of the landscape is classified as low. The aim is to “develop a minimum structure through natural, landscape-typical elements”.

Protected human being :

The planning area is located east of the existing development in the local community of Oberemmel. There is a direct connection to the main settlement area via the street “Im Großengarten”. At the moment it can be assumed that the extension to the existing daycare center opposite will not cause any significant additional noise pollution to the neighboring residential development.

Cultural and other material goods:

Reference is made to the provisions of the Rhineland-Palatinate Monument Protection Act. Earthworks and construction work must be reported in good time in accordance with Section 21 Paragraph 2 of the Monument Protection Act (DSchG).

The following causal structures and interactions must be taken into account:

  • Changes in the soil due to land use and associated changes in precipitation patterns
  • Microclimatic changes in the area of application
  • Biotope fragmentation and barrier effects
  • Change in vegetation
  • Visual impairment of the landscape
