Conversion of the procedure to a standard procedure, announcement of public participation according to Section 3 (2) BauGB

A private project developer has approached the local community of Wiltingen to enable residential development of 6 building plots adjacent to the locality in order to meet the urgent need for housing. The procedure was carried out from April 27, 2022 to mid-2023 until disclosure in the procedure according to Section 13 b of the Building Code and must now be converted to a standard procedure following the ruling of the Federal Administrative Court. The missing contents of the development plan required for this, such as the environmental report and compensatory measures, have been added so that the procedure can now be continued and brought to a conclusion. The previous procedure is considered an early participation stage according to Section 3 (1) of the Building Code and Section 4 (1) of the Building Code, so the updated planning is now being disclosed again and participation according to Section 3 (2) of the Building Code and the participation of the authorities according to Section 4 (2) of the Building Code are being carried out. The Wiltingen local council decided to carry out the disclosure at its meeting on April 25, 2024. The planning area is located in the northwest of the town west of Bahnhofstrasse and concerns parcel 31, parcels 69, 70, 73 and 85. The external compensation measure relates to parcel 44, parcel 15. The exact demarcation of the area of application covers approximately 4,900 square meters and can be seen on the attached plan. The disclosure will take place from

during general office hours in the Konz municipal administration, Am Markt 11, 54329 Konz, administration building II, 1st floor, room 76 / corridor. Citizens have the opportunity to find out about the intended planning and to comment on it. Suggestions can be submitted in writing or recorded. General office hours are: Monday to Thursday from 9 a.m. to 12 p.m. and 2 p.m. to 4 p.m., and Friday from 8:30 a.m. to 12:30 p.m. Appointments can be made by telephone on 06501/83-181 or 180, contact person Mr. Queins or Mr. Gerards, even outside of general office hours. At the same time, all documents and this announcement will also be made available for download on this page. In the previous participation stage at the end of 2022 and 2023, statements from the authorities and private individuals with environmental relevance were also made, which will also be disclosed. Some of these related to environmental concerns, e.g. statements on the FFH area were requested and a greater greening of the building area. Deutsche Bahn points out emissions from the railway line, a private individual points out the impact of noise from increased traffic as a result of the measure.

According to § 4a (6) BauGB, it is pointed out that statements not submitted on time may not be taken into account when making a decision on the development plan. Participation according to § 4 (2) BauGB was transferred to the project developer.
