Preparation of the project-related development plan for the city of Konz, Könen district, “Könener Straße 70 A” sub-area according to § 12 BauGB - conversion of the procedure to a standard procedure

The city of Konz had previously carried out this procedure in accordance with Section 13 b of the BauGB. Due to a ruling by the Federal Administrative Court on July 18, 2023, Section 13b BauGB is no longer applicable. For this reason, the preparation of the project-related development plan for the city of Konz, Könen district, sub-area “Könener Straße 70 A” in accordance with Section 13b of the BauGB, which was advanced up to the status of the statute resolution in accordance with Section 10 (1) of the BauGB, must be converted into a so-called standard procedure, in order to secure legal effect. The following is required for this: catching up on the environmental assessment, preparing the environmental report, intervention and compensation balancing, repetition of public participation in accordance with Section 3 (2) and the participation of public bodies in accordance with Section 4 (2) of the BauGB. Early information to the public and corresponding early involvement of those responsible for public affairs will be refrained from, as the previous procedure had a corresponding informational character and the renewed public interpretation has a healing effect on previous procedural steps. The result of the preliminary review under species protection law is also attached to the planning documents.

Public participation in accordance with Section 3 (2) and participation by public bodies in accordance with Section 4 (2) of the BauGB can now be carried out again. The city council of Konz decided this on December 12th. The planning area is located in the area of the Könener Straße/Valentinstraße intersection between the Könener Straße 70 property and the Saar. The location of the planning area and the delimitation of the scope can be found in the attached overview plan. The aim of the development plan is to obtain building rights for the construction of a two-storey single-family house with an access area, double garage and garden areas. in the form of a display at the Konz municipal administration. The interested public has the opportunity to comment on the intended planning and to make suggestions. In parallel with the open position, the authorities and other public bodies are involved in accordance with Section 4 (2) of the Building Code.

There is environmental information on the protected areas of people, soil, water, air and climate, as well as a preliminary review under species protection law, in which the impact on bird and animal species was examined.
