    The concept of the itinerant trade is in Section 55 Paragraph 1 of the Trade Regulations Are defined. It says:

    An itinerant trade is operated by anyone who, without prior order, operates outside of their commercial establishment ( § 42 paragraph 2 GewO ) or without having one,

    • offers goods for sale or seeks (sells) or buys orders, offers services or seeks orders for services or
    • performs independently entertaining activities as a showman or in the manner of a showman

    If you want to practice an itinerant trade, you need a permit (travel trade card). The concept of itinerant trade also includes the exercise of a trade. According to a decision by the Münster Higher Administrative Court (GewArch 87, 235), an artist who sells his paintings on the street does not operate an itinerant trade.

    The itinerant trade card can be restricted in terms of content, issued with a time limit and associated with conditions, insofar as this is necessary to protect the general public or consumers. Under these conditions, the subsequent inclusion, amendment and supplementation of conditions is also permitted ( Section 55 (3) GewO ).

    An itinerant trader is someone who moves around himself. The itinerant trader can also be an employee, since it is not important that he has his own branch. The prerequisite for this is that he acts commercially.

    Offering goods and services without an order is typical of the itinerant trade.

    Through § 55 paragraph 1 number 2 GewO the entire showman trade is covered. This also includes cabaret, variety and show performances.
