Registration of a compulsory burial

If a person dies who has no relatives (surviving dependents) who take care of the burial and no one else feels responsible for taking care of the burial, the local regulatory authority arranges for the burial of the person.
procedure
An official burial only takes place if there are no relatives of the deceased or if they cannot be identified promptly or if no one else is responsible for the burial.
If a relative or a person who is obliged to burial is identified, the authorities will issue a notice requesting this person to bury the person. If the person does not comply with this request, the authority will arrange for the burial to take place as part of the replacement service.
The costs with which the authority has submitted for the burial are to be reimbursed by the person responsible for the burial. Section 9 of the BestG provides information on who is responsible for a funeral.
The burial is to be carried out according to the will of the deceased person; if this is not known, a customary burial should take place.

Anyone who finds a deceased person must immediately inform the relatives (= person who has to be buried) or the police.
If there is no person responsible for the burial or if such a person cannot be identified in time to fulfill the burial obligation or cannot be called upon for other reasons, the regulatory authority must arrange for the burial to be carried out using regulatory means within the framework of averting danger.

The death certificate is issued by a doctor. If the death occurs at home, it is therefore particularly important to first inform a doctor in addition to a funeral home. If the death occurred in a hospital or a hospice, the relatives do not have to take care of an exhibition, this is done by the respective institution. The death certificate is required to apply for the death certificate at the responsible registry office.
What fees apply?
The costs required for a burial by the competent regulatory authority to eliminate the situation contrary to the police are to be interpreted more narrowly than the costs of a burial befitting the burial. Basically, an appropriate burial in a simple but dignified and local form is to be granted. If the party responsible for the funeral cannot be expected to bear the funeral costs, they may be entitled to have the necessary costs covered by the social welfare agency at the place of burial.
What deadlines do I need to consider?
The burial must take place within ten days of death.
The burial period begins on the day of the event and specifies the time in which the burial must take place.
