Housing for 60+ - 1st Amendment

Project-related development plan of the city of Konz, district of Könen, sub-area "Living 60plus"

1st Amendment – Announcement of the preparation pursuant to Section 2 of the German Federal Building Code (BauGB) and the public display pursuant to Section 3 (2) in conjunction with Section 13a of the German Federal Building Code (BauGB).

The city of Konz adopted the project-specific development plan (VBP) "Living 60plus" in the Könen district, in conjunction with a development and infrastructure plan (VEP) and an implementation agreement, as a statute on December 14, 2021. The development plan came into effect upon its publication on December 23, 2021. During the implementation of the "Living 60plus" project, it became apparent that adjustments to the project-specific development plan, the development and infrastructure plan, and the implementation agreement were necessary.

The city of Konz, in its meeting of February 10, 2026, resolved to prepare the project-related development plan “Living 60plus” 1st amendment in accordance with Section 2 of the German Federal Building Code (BauGB) and to make it publicly available in accordance with Section 3 (2) in conjunction with Section 13a of the German Federal Building Code (BauGB).

The amendment to the project-related development plan will be carried out using the accelerated procedure pursuant to Section 13a of the German Federal Building Code (BauGB). Pursuant to Section 13(3) of the BauGB, the environmental assessment pursuant to Section 2(4), the environmental report pursuant to Section 2a, and the statement pursuant to Section 3(2), sentence 4, regarding the types of environmental information available, as well as the summary statement pursuant to Section 6a(1) and Section 10a(1), are waived; Section 4c of the BauGB does not apply.

The draft amendment to the project-related development plan will be published in the time period

from March 30, 2026 to and including May 8, 2026

The interested public will have the opportunity to comment on the proposed changes to the plans and to offer suggestions. Comments can be sent by email to participation@konz.de The documents will be sent by mail. Additionally, they will be available for public inspection during regular office hours at the Konz municipal administration, in the foyer of the town hall, Am Markt 11, Konz. These hours are Monday to Thursday from 9:00 a.m. to 12:00 p.m. and from 2:00 p.m. to 4:00 p.m., and Friday from 8:30 a.m. to 12:00 p.m.

Suggestions can be submitted in writing or recorded in the minutes. Please note that comments submitted after the deadline may not be considered in the decision-making process regarding the development plan.

Parallel to public participation, the authorities (public bodies) are involved in the procedure according to § 4 (2) BauGB by the commissioned office.

A notice:
Pursuant to Section 44 (5) of the German Federal Building Code (BauGB) in its latest version, attention is drawn to the provisions of Section 44 (3) sentences 1 and 2 and (4) of the BauGB regarding the timely assertion of any claims for compensation for interventions in a previously permissible use by this statute and regarding the expiry of such claims. The claim for compensation expires if it is not asserted within three years after the end of the calendar year in which the financial disadvantages occurred.

Pursuant to Section 215 of the German Federal Building Code (BauGB), it is further noted that violations of the procedural and formal requirements specified in Section 214 (1) Nos. 1 to 3 of the BauGB, violations of the regulations concerning the relationship between the development plan and the land use plan that are material under Section 214 (2), and material defects in the balancing process pursuant to Section 214 (3) Sentence 2 are disregarded if they have not been asserted in writing to the City of Konz or the Konz Municipal Association Administration within one year of this publication of the statute. The facts that are alleged to substantiate the violation or defect must be presented.

Pursuant to Section 24 (6) of the Municipal Code (GemO) for Rhineland-Palatinate in its latest version, it is hereby noted that statutes which have been adopted on the basis of this law in violation of procedural and formal requirements of the Municipal Code shall be deemed to have been adopted validly from the outset one year after their publication.

This does not apply if

  1. the provisions regarding the public nature of the meeting, the approval, the execution or the publication of the statutes have been violated, or
  2. before the expiry of the period referred to in sentence 1, the supervisory authority objects to the decision or someone has notified the City of Konz or the Konz municipal administration in writing of the violation of the procedural or formal requirements, specifying the facts giving rise to the violation.

If someone has asserted an infringement according to No. 2, anyone can also assert this infringement after the above-mentioned one-year period has expired; the facts on which the violation is to be based must be explained.
