Project-related development plan "Saarterrasse Konzerbrück" in the Konzer district of Könen: Initiation of the procedure according to Section 3 (2) of the Building Code - Public display

On May 24, 2022, the Konz City Council decided to draw up the project-related development plan "Saarterrasse Konzerbrück". The reason for this planning was the plan of a private project developer to realize a larger residential construction project on the properties in the Könen district, plot 2, plots 81/7, 75/29, 75/30, 81/3 81/8 and 5/2. The project turned out to be too extensive and complex to be realized without a formal building planning procedure. The urban development conflicts triggered by the construction project will therefore be dealt with and processed in an independent development plan procedure in accordance with Section 12 Paragraph 1 of the Federal Building Code.

The scope of application was slightly modified by the city council at its meeting on June 13, 2023, due to an overlap with the scope of the "Konzerbrück II" development plan. At the same meeting, a change ban was also issued to safeguard the planning objectives (document number 3H/6773/2023).

The early consultation took place from October 21 to November 22, 2024. No comments were submitted by the public. The comments received from public interest groups and the proposed considerations can be found in the attached table. Based on the comments from the SGD Nord (Northern German Association of Public Works), the Trier Regional Trade Inspection Office, and the Trier-Saarburg District Administration, noise mitigation measures were considered in the planning. A soil assessment was prepared, and the resulting provisions were incorporated into the draft development plan.

At its meeting on July 1, 2025, the Konz City Council decided to conduct the public display pursuant to Section 3 (2) of the German Federal Building Code (BauGB) for the project-related development plan “Saarterrasse Konzerbrück”.

The public interpretation takes place in the time

from 18 July to 18 August 2025

in the form of a display at the municipal administration. This provides the interested public with the opportunity to comment on the proposed changes to the plan and submit suggestions. At the same time, the authorities (public interest bodies) will be involved by the commissioned office in the process pursuant to Section 4 (1) of the Federal Building Code (BauGB).

The draft will be available for public inspection during general office hours at the Konz Municipal Administration, Am Markt 11, 54329 Konz, Administration Building II, 1st floor, in the hallway near rooms 75 and 81. General office hours are Monday to Thursday from 9:00 a.m. to 12:00 p.m. and 2:00 p.m. to 4:00 p.m., and Friday from 8:30 a.m. to 12:30 p.m. Appointments can also be made by telephone. The contact persons are Ms. Greene (83-188) and Mr. Queins (83-181). Suggestions for the draft can be submitted in writing or recorded.

A notice:
Pursuant to Section 44, Paragraph 5 of the latest version of the Building Code (BauGB), reference is made to the provisions of Section 44, Paragraph 3, Sentences 1 and 2, and Paragraph 4 of the Building Code (BauGB) regarding the timely assertion of any compensation claims for interference with a previously permitted use by this statute and regarding the expiration of compensation claims. The compensation claim expires if the claim is not brought to maturity within three years of the end of the calendar year in which the financial loss occurred.

Pursuant to Section 215 of the Federal Building Code (BauGB), it is also pointed out that violations of the procedural and formal requirements specified in Section 214, Paragraph 1, Nos. 1 to 3 of the BauGB, significant violations of the provisions governing the relationship between the development plan and the land-use plan under consideration of Section 214, Paragraph 2, and significant deficiencies in the balancing process pursuant to Section 214, Paragraph 3, Sentence 2 are irrelevant if they have not been asserted in writing to the City of Konz or the Konz municipal administration within one year of this publication of the statute. The facts justifying the violation or deficiency must be presented.

According to Section 24 Paragraph 6 of the latest version of the Municipal Code (GemO) for Rhineland-Palatinate, it is pointed out that statutes which have been drawn up on the basis of this law in violation of the procedural and formal provisions of the Municipal Code are deemed to have been valid from the outset one year after publication.

This does not apply if

  • the provisions regarding the public nature of the meeting, the approval, the execution or the publication of the statutes have been violated, or
  • before the expiry of the period referred to in sentence 1, the supervisory authority objects to the decision or someone has notified the City of Konz or the Konz municipal administration in writing of the violation of the procedural or formal requirements, specifying the facts giving rise to the violation.

If someone has asserted an infringement according to No. 2, anyone can also assert this infringement after the above-mentioned one-year period has expired; the facts on which the violation is to be based must be explained.
