First amendment to the project-related development plan of the municipality of Nittel, sub-area "Retail" according to Section 12 of the Building Code (BauGB), announcement of the preparation resolution according to Section 2 Paragraph 1 Sentence 2 of the Building Code (BauGB) and public participation according to Section 3 Paragraph 2 of the Building Code
The municipality of Nittel developed and legally enforced the project-related development plan for "Retail" between 2017 and 2020. It has now become apparent that the original objective of establishing 650 m² of commercial space on the second floor cannot be achieved. The developer has therefore applied for a reduction from 650 m² to 320 m². This will allow for the construction of three additional apartments in place of the commercial space, for which there is still a need. The municipal council approved this proposal on June 5, 2025, and resolved to publish the plan. Since the fundamental principles of the project-related development plan are affected, the plan must be amended in a first amendment. The amendment is being carried out using a simplified procedure pursuant to Section 13 of the Federal Building Code (BauGB). The exact boundaries can be seen in the attached plan. The affected parcels are Flur 16, 7/6, 7/5, 7/3, and 7/2. The land is owned by the developer/local municipality. Disclosure pursuant to Section 3 (2) of the Building Code (BauGB) will be carried out between November 6, 2025 to December 6, 2025 The involvement of public interest bodies pursuant to Section 4 (2) of the Federal Building Code (BauGB) takes place in parallel.
