Obtain and review the rent index

A rent index gives you an overview of the rents of comparable apartments in your city or municipality. It contains guidelines,

• whether a rent increase is justified
• whether the rent level at the start of the tenancy is permissible if the apartment is located in an area where the regulations of the so-called rent control apply,
• whether the rent is generally reasonable.

The German Civil Code (BGB) and the rent index regulation distinguish between

• simple rent indices
• and qualified rent indices.

The basic rent index provides an overview of the local comparative rent. This is calculated from rents that have been newly set within the last six years, either upon re-letting or through rent increases. Rents for rent-controlled apartments are not included in the comparative rent calculation.

For such an overview to actually count as a rent index, it must be prepared or recognized jointly by the responsible authority, which is usually the municipality, or by the interest groups of landlords and tenants.

Furthermore, a qualified rent index must be compiled in accordance with recognized scientific principles. In the event of a dispute, a qualified rent index carries more weight as evidence than a simple one.

The rent index is quoted per square meter. It varies depending on...

• where an apartment is located and
• how large,
• old,
• energy-efficiently renovated
• or luxuriously equipped.

Regarding the furnishings of the apartment, the following factors play a role:

• Double-glazed windows
• structural radiators or
• Parquet flooring.

Cities or municipalities with more than 50,000 inhabitants are legally required to create a rent index.

Since July 1, 2022, all simple and qualified rent indices have been available online free of charge.

Simple rent indices should generally be updated and published every two years to reflect market developments. Qualified rent indices are required to be updated every two years and completely revised every four years.
