Section 66, paragraph 1, sentence 1 of the Rhineland-Palatinate Building Code (LBauO) lists projects for which the simplified approval procedure must be carried out. These include, for example, residential buildings of building classes 1–3 (meaning that the average floor level of no story containing habitable rooms may exceed 7 meters above ground level), including their outbuildings and ancillary facilities. For the projects listed in Section 66, paragraph 2 of the LBauO, a simplified approval procedure is only carried out if the building owner requests it and provides certificates from officially recognized experts confirming that structural stability and fire safety are ensured.
In the simplified approval procedures The building inspection is limited to admissibility according to the provisions of the German Federal Building Code (Baugesetzbuch), local building regulations (Section 88 of the State Building Code), Section 52 of the State Building Code (LBauO), and other public law regulations. Compliance of the project with building regulations, including the Rhineland-Palatinate State Building Code, is not examined.
The application for a building permit under the simplified approval procedure must be submitted to the lower building supervisory authority.
The building documents that must be submitted with the building application are specified in Section 7 of the state ordinance on building documents and structural engineering review. The building application and the building documents must be signed by the designers, who, in the case of building applications, must be authorized to submit building plans.
The building permit is valid for four years. This period can be extended upon request. The application must be received before the deadline.
What fees apply?
Fees are charged for issuing the building permit, the amount of which is essentially determined by the type of approved project. These fees are charged according to the state ordinance on fees and remuneration for official acts and services under building law (special fee schedule).
What deadlines do I need to consider?
The building authority must examine the building application within 15 working days after receiving it.

- to involve other authorities or bodies and
- to consult expert persons
If the building application is incomplete or otherwise contains significant defects, the building authority will request the applicant to rectify the defects within a reasonable period. If the defects are not remedied within this period, the application will be considered withdrawn.
The building authority must decide on projects pursuant to Section 66 Paragraph 1 of the State Building Code (LBauO) within one month, and on projects pursuant to Section 66 Paragraph 2 of the State Building Code (LBauO) within three months, provided the requirements specified in Section 66 Paragraph 5 are met. The time limit begins 15 working days after receipt of the building application by the building authority or – if the building authority has requested further documents – 15 working days after receipt of the subsequently submitted documents. If the consent or approval of the municipality is required (Section 14 Paragraph 2 Sentence 2, Section 36 Paragraph 1 Sentence 1, or Section 36a of the Federal Building Code (BauGB)), this time limit begins at the earliest upon receipt of the notification of the municipality's decision or, if the municipality's consent or approval is deemed granted due to the expiry of the time limit pursuant to Section 36 or Section 36a of the Federal Building Code (BauGB), at the point in time by which the notification of the municipality's refusal of consent or approval should have been received by the building authority.
The building permit is considered granted if no decision has been made on the building application within this period. The period can be extended by up to two months, particularly if other authorities need to be involved or decisions regarding deviations are required.
