Before submitting a building application, a written decision on individual questions of the building project (building preliminary decision) can be applied for with a preliminary building application. As an anticipated part of the building permit, a positive preliminary building permit develops a binding effect on the later building permit process.
A preliminary building application is usually useful if it is unclear whether a property can be built on at all according to the applicable building planning law. Financial expenses can be saved by submitting a preliminary building enquiry, as not all the building documents required for a building permit are required. In addition, the preliminary building permit conveys certainty about the developability of a plot of land at an early stage.
The application for a preliminary building permit must be submitted to the lower building supervisory authority. It must be accompanied by the documents necessary to assess the issues to be decided.
The building permit is valid for four years unless it is limited to a shorter period. This deadline can be extended upon request, which must be received before the deadline.

For the building permit, fees are charged in accordance with the state ordinance on fees and remuneration for official acts and services in accordance with building law (special fee schedule).
