In the case of a restricted tender (national), the contracting authority (awarding body) asks certain companies to submit a bid. This also applies to the restricted procedure (EU-wide). This is to be carried out if the order volume exceeds the threshold value.
In both cases, competition is restricted because the company must already be known to the contracting authority.
Notice: If the expected order value of the planned restricted tender exceeds EUR 25,000 excluding sales tax, contracting authorities must inform the companies in advance. This preliminary information will be published in the special tender media.
The contracting authority can conduct a public participation competition in advance. In the case of restricted procedures and, in certain cases, also in the case of restricted tenders, the participation competition is obligatory. For this purpose, the awarding authority publicly announces the planned award of the contract in special tendering media. All interested companies can submit applications to participate. The awarding authority selects the suitable companies in compliance with the general award principles. She asks them to place a bid.

A restricted invitation to tender or a restricted procedure is only possible under certain conditions, for example in the following cases:
- Certain value limits are not exceeded for construction work (national).
- Due to special requirements, only a certain group of entrepreneurs can provide the service.
- A public tender would cause a disproportionate amount of work for the contracting authority or the applicant company.
- A public tender that has already been carried out has not led to an acceptable or economic result.
- A public tender is inappropriate, for example, for reasons of urgency or confidentiality.

What fees apply?
Costs that you incur for processing the offer will not be reimbursed.
Exception: The customer requests the preparation of drafts, plans, drawings, calculations or other documents. In this case, he must uniformly reimburse reasonable costs to all applicants.
