If there is not enough space on your construction site, you may have to temporarily use a public area. If you want to use public areas in connection with your construction site, this constitutes special use. You must apply for a permit (special use permit) from the responsible authority in advance.
Work sites/construction work that affect the road and traffic must be secured by traffic signs/traffic facilities and road traffic must be regulated.
If roads, paths and squares have to be used for work sites/construction work or other uses (e.g. storing building materials, setting up construction equipment), these areas must be secured with traffic signs and traffic facilities. It does not matter whether the work sites/construction work are on the road itself or work is next to or above the road.What documents are required?
- Informal application for a special use permit
- Documents that explain the type and extent of the special use (for example, a sketch with dimensions)
- You may be required to provide additional documentation. The responsible authority will inform you accordingly during the process.
Before starting work that affects road traffic, those responsible must obtain instructions from the competent authority on how their work sites are to be cordoned off and marked, whether and how traffic is to be restricted, directed and regulated and, if necessary, how traffic lights are to be operated. According to Section 45 Paragraph 6 of the Road Traffic Act, building contractors must submit a traffic sign plan, but other companies do not.
When submitting the application, the following must be stated:
- Complete address details of the applicant including telephone number/e-mail for queries
- Type of concrete project
- Precise location information/description of the location/possibly Making a sketch
- Duration/period of the measure (if necessary with time)
- Person responsible for traffic safety with full name and telephone number so that he can be reached at any time
What fees apply?
There is a fee for issuing the permit. Fees may also be charged for using the area. The amount of the fee depends on the type, extent and location of the special use.
The scale of charges for road traffic measures provides for a range of charges between EUR 10.20 and EUR 767 (depending on the duration and scope of the job, classification of the road, any on-site visits, etc.). There may be special usage fees according to municipal special usage fee statutes.
What deadlines do I need to consider?
None. You must have the permit before you begin the special use.
The applicant (construction company, private individual) must apply in writing for the traffic law order at least two weeks before the start of work (no binding form).

Even if all the actual and legal requirements are met, you are not entitled to be granted a special use permit. The responsible authority decides on your application at its own discretion.
The responsible authority will usually grant you the special use permit for a limited period and with a right of revocation. This means that the permit granted can be withdrawn. The permit is usually subject to conditions that you must fulfill.
The responsible authority may require you to pay for the repair of damage caused by your special use. The responsible authority may also require you to make an advance payment or deposit a sum of money as security.
Official traffic signs and devices may only be installed if they have been previously ordered by the competent authority.
The applicant/contractor must independently implement the traffic safety measures ordered by the road traffic authority.
Private individuals can also use a specialist company for this purpose or borrow the traffic signs and equipment from them. In individual cases, barrier material can also be borrowed from municipal building yards (possibly for a fee); the road traffic authorities can also provide information on this in individual cases.
