By making a declaration to the building supervisory authority, property owners can assume public-law obligations relating to an action, toleration or omission that does not already result from public building law. The construction load is intended to remove obstacles that could stand in the way of development (or change of use) in individual cases. One example here is the parking lot construction burden, which can be used under certain conditions to ensure under public law that the necessary car parking spaces are created on another piece of property within a reasonable distance.
Anyone who demonstrates a legitimate interest can inspect the register of building encumbrances and obtain copies.
What fees apply?
Written information from the register of building encumbrances is subject to a fee. The level of fees results from the state ordinance on fees and remuneration for official acts and services under building law (special fee schedule).
