In order to guarantee the rest period on Sundays and public holidays and the rest of the sales staff, sales outlets are generally closed on Sundays and public holidays. Per year maximum four general shopping Sundays per municipality be released by ordinance. There is no entitlement to the release of shopping Sundays from the municipality. The permitted opening time must not exceed five hours; it must not be between 6 a.m. and 11 a.m.

In order for a Sunday shopping to be approved by the competent authority, there must be a special reason in each case. No applications were made for 2023.
What documents are required?
An application must be submitted stating who the organizer is, e.g. B. Advertising association of the city of XY, when the Sunday shopping should be and in which district it should take place.
What fees apply?
There are no fees.
What deadlines do I need to consider?
Since a hearing procedure is mandatory, the application should be received by the authority about six weeks before the planned Sunday shopping.

What else should I know?
It is necessary for the municipalities, as legislators, to make a sufficient assessment of the need for regulation for the release of Sunday shopping and the protection of the Sunday before making a decision on the release of Sunday shopping. This weighing decision is to be attached to the draft of the RVO as a justification for the hearing of the trade unions, employers' and business associations, churches and other relevant institutions.
It should be noted that public holidays cannot be released for reasons of public holiday protection. The Shop Opening Act also stipulates that no sales outlets may be allowed to remain open on Easter Sunday, Whitsunday, National Day of Mourning, Sunday of the Dead, on Sundays in Advent in December and on Sundays on which a public holiday falls.
The release of the 1st Advent Sunday in November is possible. No "consecutive" Sundays may be released. The respective release can be seen on a community basis.
